Hyon M. Kientzy
Hyon joined Coddington, Hicks & Danforth in 2000, with a focus on complex insurance coverage and bad faith actions. Since that time, she has developed a sophisticated practice encompassing a wide range of litigated and non-litigated matters.
Hyon helped spearhead and develop the firm's robust class action practice, defending suits arising from issues ranging from allegations of improper claims handling, unfair business practices, fraud, institutional bad faith, and corporate compliance issues. She been appointed lead defense counsel in a class action valued in excess of $90M, served on steering committees in large multi-defendant, nationwide class actions, and has been called upon to manage large scale, complex class claim administration and evaluation processes.
In representing the firm's insurer clients, Hyon has handled all aspects of the cases from inception through verdict and appeal, and has also provided amicus curiae support on issues pending before various Courts of Appeal that have significant industry impact. The complex breach of contract and bad faith actions she handles include numerous other claims, such as spoliation of evidence, fraud, misrepresentation, rescission and policy reformation. With intelligent litigation strategy and a strong command of each case she handles, Hyon has successfully disposed of many actions via summary judgment and achieved very favorable settlements in mediation.
With her in-depth institutional knowledge of her clients and the business of insurance as a whole, Hyon has expanded her practice to include providing advice and counsel on numerous regulatory matters, as well as training and counseling on best practices for corporate compliance. She is often asked to provide her insights to industry groups and other interested parties regarding proposed legislation throughout the country on a broad spectrum of issues involving the business of insurance and matters of public policy, including underwriting/rating, fair claims settlement practices, and issues stemming from the rise of peer-to-peer services in the current Sharing Economy. In 2015, Hyon was called upon to testify before the California Senate Insurance Committee to provide her expertise on proposed changes to the complex body of law governing Uninsured Motorist/Underinsured Motorist claims.
Hyon also represents and advises companies on general business matters, including employment related issues, contracts, and ADA compliance. She had handled investigations on behalf of employers for claims arising from allegations of discrimination and harassment. She has also represented individuals and businesses in real property disputes, including those stemming from construction defects and partition proceedings.
Hyon has been recognized on numerous occasions by Northern California Super Lawyers as having earned a high-degree of peer recognition and professional achievement. She is a member of the Association of Defense Counsel for Northern California and Nevada, the Defense Research Institute, the Bar Association of San Francisco and served on the Board of Directors of the Korean American Bar Association. She has also volunteered countless hours to her community, including pro bono services to assist victims of domestic abuse and to advocate for the interests of abused and neglected children in the juvenile court system.
