Real Property

The law firm of Coddington, Hicks & Danforth represents clients in commercial and residential real property transactions and litigation.  We draft and review commercial and residential leases, and assist in homeowner disputes involving such issues as boundary disputes and trespass.  We also represent condominium owners,  homeowners associations,  and  government entities in all types of real property disputes.  From our Redwood City office, we are able to assist clients with real property issues throughout California.

Commercial & Residential Leases

Our attorneys assist clients in negotiating, writing, and reviewing commercial and residential leases.  A thorough and well-drafted lease is essential to protect the interests of the parties involved and to prevent against future disputes.  Our attorneys can assist clients in considering all of the possible issues that may arise during a lease period, including the lease term; description, use, and condition of the premises; payment periods, rent increases, late charges, and security deposits; responsibility for utilities; improvements; assignments or subletting; holdovers and abandonment; and much more.  Commercial landowners should also consider such essential issues as commercial insurance, going dark rights, hours of operation, and business sales.

Homeowner Disputes

We assist homeowners in real property disputes involving such issues as boundary line disputes, adverse possession, trespass, intrusion, nuisance, and other issues that are common among neighbors.  Boundary disputes are one of the most common issues homeowners face.  Such disputes can arise because of improvements built over property lines, such as fences or pools; improvements which impede on another’s use and enjoyment of property, for example, a second story addition that blocks a homeowner’s valued view; and roads or utilities that cross over neighboring properties.   In some situations, a neighbor may claim to have acquired a "prescriptive easement" for a road, power line or other necessity because they have “always” had use of the land for that purpose or because their property is otherwise "landlocked;" or they may have been granted an easement in a recorded deed.  Our knowledgeable attorneys can help clients determine and protect their property rights.

Homeowners Associations (HOAs) & Condominiums

As experienced business and real property attorneys, we counsel homeowners associations and condominiums on issues relating to ownership, maintenance, and compliance with applicable laws and regulations, including environmental regulations.  In addition, we assist with all types of disputes over ownership and home maintenance between condominiums, HOAs, and their residents.

Government Entities & Real Property

Our firm also assists government entities in real property disputes.  We handle nuisance litigation involving allegations by private homeowners of water damage to properties caused by leaking sewage pipes or excess water discharged into streams causing overflow.  We also assist with issues such as redevelopment, inverse condemnation and eminent domain disputes, land use and zoning, and other water, sewer, and infrastructure issues.
